Loo Wai Hoong’s (雷伟雄) experience spans over a decade. He started out in a large prestigious full-service law firm and was a Partner of an intellectual property specialist law firm. He commenced this practice to advocate for “legal means to a commercial end”.
Wai Hoong has been litigation counsel in Federal Court and Court of Appeal appeals as well as High Court trials, hearings and interlocutory applications. He supports and advises law enforcement authorities and public prosecutors procedurally and evidentially in criminal intellectual property prosecutions. He facilitates court orders to freeze infringers’ assets and co-ordinates brand owners’ expert witnesses to authenticate seized counterfeits in court.
Wai Hoong conducts anti-counterfeiting and brand protection criminal enforcement actions for internationally well-known brand owners in Malaysia and the Asian region including China. His expertise involves raids with the Enforcement Division of the Ministry of Domestic Trade and Cost of Living (MDT) to seize counterfeits within various industries and border control measures by the Royal Malaysian Customs Department against the importation of infringing goods.
Wai Hoong executes Cease and Desist (C&D) Letter actions to enforce his clients’ rights for out-of-court settlements and recover damages. He takes down infringing local and foreign e-commerce websites, stores and counterfeit product listings. He terminates infringing companies’ / businesses’ registrations and trade names from the Register of Companies / Businesses.
Wai Hoong conducts investigations and collaborates with investigators to gather evidence of local and cross-border infringements and counterfeiting syndicates in Malaysia and the Asian region including China.
Wai Hoong engages with governmental authorities. He proposed amendments and recommendations on enforcing laws including the Trademarks Act 2019, Consumer Protection (Electronic Trade Transactions) Regulations 2012, MDT’s Guidelines on the Lodgment of Trademark Enforcement Complaints and other regulations. He moderated brand owners, e-commerce platforms and MDT Roundtable Discussions combatting counterfeits on local and foreign online marketplaces. He trains MDT and Customs officers regarding anti-counterfeiting measures and authentication.
Wai Hoong handles end-to-end intellectual property applications and registrations. It includes appeals, ex parte hearings and opposition proceedings before the Registrar of Trademarks at the Intellectual Property Corporation of Malaysia (MyIPO), assignments, licensing transactions, copyright voluntary notification, patent and industrial design prosecution as well as trade secrets and other intellectual property matters.
Wai Hoong is a member of the International Trademark Association (INTA). As a way of giving back, he is the Chair of the INTA Unreal Campaign East Asia & Pacific sub-committee to educate young consumers about the value of trademarks and risks of buying counterfeits worldwide. He has also conducted pro bono criminal cases. He was an Instructor on INTA’s “The Lifecycle of a Trademark” International Certificate Program regarding trademark registration processes and protection measures. He authored articles and regularly speaks on intellectual property and its enforcement at international conferences and seminars.
Outside of the law, Wai Hoong hikes hills and mountains up till the Everest Base Camp and (metaphorically) his goals.
