Across the straits for an International Trademark Association (INTA) Unreal Campaign presentation in conjunction with the INTA Annual Meeting 2023 in Singapore!

Thanks to Temasek Polytechnic and Annie Perumpoykail Gomez for having me as well as our committee members Pui Keng Lim, Roberta Calazans, Aprajita Nigam and Yoshi Masutani.

Broadened my horizons by garnering a Singaporean perspective on counterfeits and why trademarks matter to the audience. Also shared a brief Malaysian legal perspective and experiences in cases involving international and South East Asian counterfeit “black market” syndicates including Singapore for a cross-border comparison.

Trust that it helped to raise awareness among the audience while I delved into the minds of overseas consumers. Excited for more future opportunities to exchange views.

Personal Data Protection Notice

Collection and processing
Your personal data has been and will be collected to be processed and / or on your behalf in the course of your present or future dealings with Messrs. Loo Wai Hoong, its proprietor(s) / partner(s) and / or permitted person(s) (“Firm”). Your personal data enables the Firm to achieve the purposes stated herein that is in connection with its business.

Your personal data, for the purposes of this Notice, includes but is not limited to your name, identity card / passport number, gender, e-mail address, contact numbers, images (still / recording), videos, sensitive personal data and any Personally Identifiable Information (PII) defined by international privacy laws or standards.

    Services
  • provision of the Firm’s services;
  • your / clients’ records maintained in relation to matters of and services provided by the Firm;
  • communications with or notifications of the Firm’s services to you / clients via e-mail, telephone calls, text messages or social media;
  • service / delivery of documents;
  • business or credit assessments and other background checks deemed necessary or appropriate by the Firm;
  • collection of outstanding fees or payments;
    • Appointment & Engagement
  • appointing the Firm as your / clients’ advocate and solicitor;
  • entry into engagements, agreements, contracts and / or arrangements for services from the Firm;
  • necessary performance of other obligations under such appointments, engagements, agreements, contracts and / or arrangements; and
    • Regulatory Compliance
  • compliance with any necessary disclosure, legal or regulatory requirements governing the provision of the Firm’s services.

Sources
The Firm may obtain your / clients’ personal data from sources which include but are not limited to forms, the Firm’s website, cookies, business cards, publicly available sources or information provided to the Firm.

Disclosure to Third Parties
The Firm may disclose your / clients’ personal data to service providers, business / companies or individuals including but not limited to the Firm’s accountants, auditors, banks, insurance providers, information technology (IT) service providers, business partners, legal directories, third-party service providers or governmental / regulatory authorities in compliance with regulatory requirements. Your / clients’ personal data will be disclosed in accordance with this Notice and applicable Data Protection legislations. Your / clients’ personal data will be processed for the purposes and within the terms stated herein.

Transfer of Personal Data
The Firm may transfer, store, use and process your / clients’ personal data in information technology storage servers and facilities outside Malaysia for the purposes stated herein.

Your Obligations
It is necessary for the Firm to collect and retain your / clients’ personal data. Therefore, it is also obligatory for you / clients to provide personal data in the most accurate manner. Failing which, the Firm is unable to process personal data on your / clients’ behalf for the purposes stated herein or effectively render the Firm’s services.

Your Rights

To request access to personal data
 You / clients have the right to request for access to personal data kept and processed by the Firm with reasonable notice.

To request correction of personal data 
You / clients have the right to request for the correction and / or update of your personal data that is inaccurate, incomplete or out-of-date.

To limit processing of your personal data
You / clients are entitled to limit the Firm’s processing of your / clients’ personal data by expressly withdrawing prior consent, in each case, subject to any applicable legal restrictions, contractual conditions and within a reasonable time period.

Changes to Notice
The Firm reserves the right to amend this Notice from time to time without prior notice. It is advisable to refer to the Firm’s website or this Notice and its amended versions. You are deemed to have provided consent and accepted the contents of this Notice and its amended versions when instructing the Firm.

Notis Perlindungan Data Peribadi

Menurut Akta Perlindungan Data Peribadi 2010 dan peraturannya, Notis ini dikeluarkan kepada semua anak guam dan bakal anak guam yang dihargai. Notis ini akan memaklumkan anda tentang hak anda berkenaan dengan data peribadi anda yang telah dan / atau akan dikumpul dan diproses.

Pengumpulan dan pemprosesan
Data peribadi anda telah dan akan dikumpul untuk diproses dan / atau bagi pihak anda dalam pengendalian anda kini atau pada masa hadapan dengan Tetuan Loo Wai Hoong, pemilik / rakan kongsinya dan / atau orang yang dibenarkan (“Firma”). Data peribadi anda membolehkan Firma untuk mencapai tujuan yang dinyatakan di sini yang berkaitan dengan perniagaannya.

Data peribadi anda, bagi tujuan Notis ini, termasuk tetapi tidak terhad kepada nama, nombor kad pengenalan / pasport, jantina, alamat e-mel, nombor perhubungan, imej (pegun / rakaman), video, data peribadi sensitif dan sebarang Maklumat Pengenalan Peribadi (Personally Identifiable Information (PII)) yang ditakrifkan oleh undang-undang atau piawaian keperibadian antarabangsa.

Tujuan Pengumpulan
Firma boleh mengumpul dan menggunakan data peribadi anda untuk tujuan berikut termasuk tetapi tidak terhad kepada:

    Perkhidmatan
  • pembekalan perkhidmatan Firma;
  • rekod anda / anak guam yang disimpan berhubung dengan perkara dan perkhidmatan Firma;
  • komunikasi dengan atau pemberitahuan perkhidmatan Firma kepada anda / anak guam melalui e-mel, panggilan telefon, mesej teks atau media sosial;
  • penyampaian / penghantaran dokumen;
  • penilaian kredit atau perniagaan dan semakan latar belakang lain yang dianggap perlu atau sesuai oleh Firma;
  • pungutan fi atau bayaran tertunggak;
    • Pelantikan & Pengambilan
  • mengambil Firma sebagai peguam bela dan peguam cara anda / klien;
  • kemasukan ke dalam pengambilan, perjanjian, kontrak dan / atau pengaturan untuk perkhidmatan Firma;
  • pelaksanaan kewajipan lain yang perlu di bawah pengambilan, pelantikan, perjanjian, kontrak dan / atau pengaturan tersebut; dan
    • Pematuhan Kawal Selia
  • pematuhan sebarang penzahiran yang perlu, keperluan undang-undang atau peraturan yang mentadbir pembekalan perkhidmatan Firma.

Sumber
Firma boleh memperolehi data peribadi anda / anak guam daripada sumber yang termasuk tetapi tidak terhad kepada borang, laman web Firma, kuki, kad perniagaan, sumber terbuka atau maklumat yang diberikan kepada Firma.

Penzahiran kepada Pihak Ketiga
Firma boleh menzahirkan data peribadi anda / anak guam kepada pembekal perkhidmatan, perniagaan / syarikat atau individu termasuk tetapi tidak terhad kepada akauntan, juruaudit, bank, pembekal insurans, pembekal perkhidmatan teknologi maklumat (IT), rakan kongsi perniagaan, direktori undang-undang, pembekal perkhidmatan pihak ketiga Firma atau pihak berkuasa kerajaan / kawal selia menurut keperluan kawal selia. Data peribadi anda / anak guam akan dizahirkan menurut Notis ini dan undang-undang Perlindungan Data yang berkenaan. Data peribadi anda / anak guam akan diproses untuk tujuan dan dalam terma yang dinyatakan di sini.

Pemindahan Data Peribadi
Firma boleh memindahkan, menyimpan, menggunakan dan memproses data peribadi anda / anak guam dalam pelayan dan kemudahan storan teknologi maklumat di luar Malaysia untuk tujuan yang dinyatakan di sini.

Kewajipan Anda
Ia adalah perlu bagi Firma untuk mengumpul dan menyimpan data peribadi anda / anak guam. Oleh itu, ia adalah juga wajib bagi anda / anak guam untuk memberi data peribadi dengan cara yang paling tepat. Jika gagal, Firma tidak dapat memproses data peribadi bagi pihak anda / anak guam untuk tujuan yang dinyatakan di sini atau membekalkan perkhidmatan Firma dengan berkesan.

Hak Anda

Untuk meminta akses kepada data peribadi
Anda / anak guam mempunyai hak untuk meminta akses kepada data peribadi yang disimpan dan diproses oleh Firma dengan notis yang munasabah.

Untuk meminta pembetulan data peribadi
Anda / anak guam mempunyai hak untuk meminta pembetulan dan / atau pengemaskinian data peribadi anda yang tidak tepat, tidak lengkap atau lapuk.

Untuk mengehadkan pemprosesan data peribadi anda
Anda / anak guam berhak untuk mengehadkan pemprosesan data peribadi anda / anak guam oleh Firma dengan menarik balik kebenaran yang diberikan terlebih dahulu dengan nyata, dalam setiap kes, tertakluk kepada sebarang sekatan undang-undang, syarat kontrak yang berkenaan dan dalam tempoh masa yang munasabah.

Pindaan Notis
Firma mengekalkan hak untuk meminda Notis ini dari semasa ke semasa tanpa notis terlebih dahulu. Ia adalah dinasihatkan untuk merujuk kepada laman web Firma atau Notis ini dan versi Notis yang dipinda. Anda dianggap telah memberikan persetujuan anda dan menerima kandungan Notis ini dan versi Notis yang dipinda apabila memberi arahan kepada Firma.
